Order On order of the Court, the application for leave to appeal is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the order dismissing the plaintiff's appeal and REMAND this case to the Workers' Compensation Appellate Commission for reconsideration. In its March 30, 1992 order of dismissal the Commission stated that the plaintiff had ""failed to respond to defendant's motion,"" when the fact is, as the record shows and the, parties acknowledge, that the plaintiff filed an answer opposing the motion, along with an untimely brief on appeal, on or about February 24, 1992. The Commission is directed to reconsider the defendant's motion in light of this fact. We express no opinion concerning what the outcome should be.
